Top Matchmaker (the “Website”) is a platform which provides opportunities for single people to meet in person for the purpose of a fulfilling relationship.  Top Matchmaker host speed dating events, blind dinner dates, social events, matchmaking packages, nature and hiking events which are created by Top Matchmakers or affiliated associates of Top Matchmaker.

• Acceptance of Terms

Please read these Terms and Conditions carefully (the “Terms”).   By accessing this site and any pages thereof, you agree to be bound by the Terms and Conditions below.  By using the website, reading the content confirms that you have read, understood and agree to be bound by the Terms.  If you do not agree to the terms and conditions below, do not access the site, or any other pages thereof.

• Top Matchmaker reserves the right to change, alter, edit, update Terms at its own discretions, however will endeavor to notify members of any changes.

• Eligibility

You must be 18 years of age or older to use or facilitate the services on this website.  You must not use the website if you are a competitor or ours, or if you wish to use ideas, contents, images, event ideas for your own purposes.    You must not use the website if you have been banned or your membership has been cancelled.   

• No refund Policy

Top Matchmaker conveys the importance of showing up to scheduled events, a considerable amount of time and organisation has gone into each event as we like to have an even ratio of men and women at each event.    If for some reason you have to cancel we ask that you give us at least 5 days notice, you will be given a credit for another event within Top Matchmaker but we do have a No Refund Policy. Your purchase will Not be issued a refund.   Your ticket may be transferred to a friend if it was for Speed Dating or a Socialise Event (not including Blind Dinner Dates or any of the Matchmaking Packages).

• You will be given the opportunity to buy tickets direct from the website, telephone or by emailing bookings@topmatchmaker.com.au via credit card MC/Visa, Paypal or direct EFT into our nominated account.
• You acknowledge and agree that the purchase of tickets are non-refundable and paid in advance.

• Blind Dinner Dates and Matchmaking Packages

Top Matchmakers will do all possible to match you in hope to find your perfect mate, this will based on our phone consultation, questionnaire and we will ask for a video introduction with a few simple questions, this will allow us to see how you talk and reveal some of your personality, which will be kept confidential to Top Matchmaker and be only be used to assist our matchmaking process.   We also invite you to attend a socialise event that Top Matchmaker holds at no charge so we can get to know you better and understand what type of person you are drawn to, you may want to come to one of our Functions or even attend one of our Singles Hiking events.       In all good faith if you have not found your match after 3 matched dates we will give complimentary speed dating credits or other such credit to ongoing events.

• BACKGROUND

For speed dating and socialise events which includes function events and nature walks you understand that Top Matchmaker does not inquire into the background of members or attempt to verify their statements of its members. Top Matchmaker does not represent the individual’s behavior or warranties as to conduct of its members or their compatibility with any current or future members.

 

• ID

Top Matchmaker may check ID before the event, on arrival at the Speed Dating events or ask for ID during the event if questionable about your age.  If your ID shows to not be in the age range of the speed dating you may be refused participation on that event and be offered to attend another event on the suitable age range.

 

3. Blind Dinner Dates and Matchmaking Packages

ID will be asked on registration, we may also ask if you have had any criminal convictions included and not limited to Domestic Violence, stalking and/or harassment.  A background check will likely occur.

 

• Safety Dating Obligations

You will agree that you will not publish, showcase, broadcase, transmit or upload content in relation to your forthcoming dates or thereafter associated with Top Matchmaker, you agree to not falsify, misleading information to Top Matchmaker or potential matches, you agree to not harass, impersonate, stalk, threaten another member of the website.  

Top Matchmaker will use best practices to keep personal information protected, but we ask all members and applicants to follow the below dating procedures

We ask if matched at a speed dating, socialise, nature, blind dinner or matchmaking to that it takes place in a public environment.

That you agree to not meet another member in a non public place such as at home, park, a nature walk if only 2 of you or any such secluded area.

We encourage if meeting through a planned event that you do not exchange personal information, such as telephone, email, social media name, home address, full name and place of work.  This information will only be provided after meeting up on a first successful date only.   If you meet another member and you wish to stop communication this will ensure a smooth and easier disconnection if you correspond through Top Matchmaker via email or phone.   We inform to not stalk in person or through social media, or try to make contact with another member once you have met through any event unless you have contacted Top matchmaker to see if the other person would like to be contacted first.

You understand that if you do arrange to meet another member that you are liable and responsible for making the meeting arrangements.   You are responsible to attend and meet at the date, venue as agreed between both parties.  Not attending an arranged meeting may result in forfeit of payment and being a member of Top Matchmaker.  We ask for safety purposes that you let a Top Matchmaker know via email of your date arrangements.

 

• Postponement or Cancellation

Events are rarely postponed or cancelled however if this was to occur such as bad weather on one of our Singles Hiking Events, a venue incident so forth, or the number of applicants were not matched that would determine a successful event then Top Matchmakers will postpone the event and give you credit for another event soon coming up.   We will notify applicants via Email and/or SMS and give you new dates of upcoming scheduled events.

 

• General Disclaimer

 

Third Party

Top Matchmaker has no control over such Sites and Third Party Applications, Software or Content or the promotions, materials, information, offers or services available on these Third Party Sites or Third Party Applications, Software or Content. Such Third Party Sites and Third Party Applications, Software or Content are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us;

So therefore Top Matchmaker is not responsible for any Third Party Sites accessed through our website or any Third Party Applications, Software or Content posted on, available through or installed from Top Matchmaker website, including the content, accuracy, offensiveness, opinions, reliability, privacy practices or other policies of or contained in the Third Party Sites or the Third Party Applications, Software or Content.  Inclusion of, linking to or permitting the use or installation of any Third Party Site or any Third Party Applications, Software or Content does not imply approval or endorsement thereof by Top Matchmaker Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).                

• We may offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

 

 

4. Limitation of Liability

Top Matchmaker is not responsible and is not liable for any loss or liability that may incur, not limited to personal injury and/or loss, for this reason Top Matchmaker does not require, nor holds, any insurance for applicants or members.   All members and applicants are responsible for their own health and safety whilst attending any event, date or meet up.

• Whilst every endeavour is made to provide satisfactory and efficient services to our clients we cannot be held responsible for an applicants and members safety and behaviour at any event.
• Top Matchmaker will not be liable to You or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from Your use of the Website/ Application or the Service, as well as damages for loss of date, loss of programs, cost of procurement of substitute Services or Service interruptions, even if Top Matchmaker knows or has been advised of the possibility of such damages. Top Matchmaker is not responsible for any expenses that you may have related to communicating with users on our site but outside of using our services our services (including, but not limited to expenses related to event, meetings etc.). Those expenses are your own responsibility. Notwithstanding anything to the contrary contained herein.
• Top Matchmaker does not control and is not responsible for the behaviours and actions of its members, their comments, posts or information that they upload or communicate with. Accordingly, Top Matchmaker is not responsible for any offensive, inappropriate, obscene or unlawful content you may encounter on the Website or in connection with any of the services provided on the Website (including meet-ups, events, meetings)

 

• Indemnification

• You agree to indemnify, defend, and hold harmless Top Matchmaker.com.au.au, Top Matchmaker, associated companies and the officers, directors, employees, agents, licensors and suppliers from and against all losses, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions, or any activity related to use of the site (including negligent or wrongful conduct) by you or any other person accessing the website using your Internet account or when you attend any hosted event, blind dinner date, matchmaking package or any event affiliated with Top Matchmaker or Top Matchmaker. Use of the website, the services, and any of the Products brought through Top Matchmaker are at your own risk.
• Nothing in these Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.
• Subject to this clause, and to the extent permitted by law: (a) all terms, guarantees, warranties, representations or conditions which are not expressly stated in these Terms are excluded; and (b) Top Matchmaker will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms (including as a result of not being able to use the Services or the late supply of the Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise. Use of the Website, the Services, and any of the products of Top Matchmaker, is at your own risk. Everything on the Top Matchmaker, the Services, and the products of Top Matchmaker, are provided to you “as is” and “as available” without warranty or condition of any kind. None of the affiliates, directors, officers, employees, agents, contributors, third party content providers or licensors of Top Matchmaker make any express or implied representation or warranty about its Content or any products or Services (including the products or services of Top Matchmaker) referred to on the Website. This includes (but is not restricted to) loss or damage you might suffer as a result of any of the following: (a) failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records; (b) the accuracy, suitability or currency of any information on the Website, the Service, or any of its Content related products (including third party material and advertisements on the Website); (c) costs incurred as a result of you using the Website, the Services or any of the products of Top Matchmaker; (d) the Content or operation in respect to links which are provided for the Member’s convenience; (e) any failure to complete a transaction, or any loss arising from e-commerce transacted on the Website; or (f) any defamatory, threatening, offensive or unlawful conduct of third parties or publication of any materials relating to or constituting such conduct.
• You expressly understand and agree that Top Matchmaker, its affiliates, employees, agents, contributors, third party content providers and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.

Termination of Contract

• The Terms will continue to apply until terminated by either you or by Top Matchmaker as set out below.

 If you want to terminate the Terms, you may do so by: (a) notifying Top Matchmaker at any time; and (b) closing your accounts for all of the services which you use, where Top Matchmaker has made this option available to you. Your notice should be sent, in writing, to Top Matchmaker via the ‘Contact Us’ link on our homepage.

Top Matchmaker may at any time, terminate the Terms with you if: (a) you have breached any provision of the Terms or intend to breach any provision; (b) Top Matchmaker is required to do so by law; (c) the partner with whom Top Matchmaker offered the Services to you has terminated its relationship with Top Matchmaker or ceased to offer the Services to you; (d) Top Matchmaker is transitioning to no longer providing the services to Members in the country in which you are resident or from which you use the service; or (e) the provision of the services to you by Top Matchmaker is, in the opinion of Top Matchmaker, no longer commercially viable.

Subject to local applicable laws, Top Matchmaker reserves the right to discontinue or cancel your membership at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts Top Matchmaker’s name or reputation or violates the rights of those of another party.

When the Terms come to an end, all of the legal rights, obligations and liabilities that you and Top Matchmaker have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of this clause shall continue to apply to such rights, obligations and liabilities indefinitely.

Indemnity

• You agree to indemnify Top Matchmaker, its affiliates, employees, agents, contributors, third party content providers and licensors from and against: (a) all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with any Content you post through the Website; (b) any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so and any breach by you or your agents of these Terms; and/or (c) any breach of the Terms.

Dispute Resolution

• Compulsory: If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sort).

Notice: A party to the Terms claiming a dispute (“Dispute”) has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.

Confidential All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as “without prejudice” negotiations for the purpose of applicable laws of evidence.

• Venue and Jurisdiction

The Services offered by Top Matchmaker are intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of New South Wales, Australia.

• Governing Law

This agreement is governed by the laws of New South Wales, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to this agreement and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of New South Wales, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. This agreement shall be binding to the benefit of the parties hereto and their successors and assigns.

• Independent Legal Advice

Both parties confirm and declare that the provisions of this agreement are fair and reasonable and both parties having taken the opportunity to obtain independent legal advice and declare the Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.

• Definitions

• In these Terms and Conditions the following words have the following meanings unless the context requires otherwise:

1. “Agreement” means the agreement between the User and Top Matchmaker and its subsidiaries, including but not limited to Top Matchmaker.com.au, incorporating these Terms and Conditions for the provision of the Service;
2. ”Applicant” “User” “Member” a person applying/registering for an event
3. ”Intellectual Property Rights” means all patents, database rights, copyrights, registered and unregistered xdesign rights, registered and unregistered trademarks and any other similar rights wherever existing in the world together with the right to apply for protection of the same;
4. ”Liability” means the liability for any and all damages, claims, proceedings, actions, awards, expenses, costs and any other losses or liabilities;
5. ”Other User” means any person who browses the Web Site;
6. ”Posting” means displaying, exhibiting, publishing, distributing, transmitting or disclosing information, details or other material on the Service, and the phrases “Post” and “Posted” shall be constructed accordingly;
7. ”Profile” means the section of the containing details, photographs and/or information about the User composed and Posted by the User;
8. Service” means the service provided by Top Matchmaker to the User including, but not limited to, Top Matchmaker allowing the User to browse the Web Site, to contact and/or to be contacted by other Members through the Web Site and/or to Post information on the Web Site;
9. ”Terms and Conditions” the terms and conditions of use of the Services as represented by this Agreement and as varied and as amended by Top Matchmaker at its full discretion at any time and published accordingly on the Web Site.
10. ”User” means the person whose application for membership of the Service is accepted by Top Matchmaker.
11. ”Web Site” means the web site at URL www.topmatchmaker.com.au (or any such other URL that Top Matchmaker may use to provide the Service from at their discretion)
12. Unless the context otherwise requires, words in the singular include the plural and vice versa and words in one gender include any other gender.

 

• Advertising

• We, and our licensees, may publicly display advertisements and other information adjacent to or included with Your Content. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you.

• User Consent To Receive Communications In Electronic Form

For contractual purposes, you (a) consent to receive communications from Top Matchmaker in an electronic form via the email address you have submitted; and (b) agree that all Terms and condition, agreements, notices, disclosures, and other communications that Top Matchmaker provides to you electronically satisfy any legal requirement that such communications would satisfy if it were in writing.  The foregoing does not affect your non-waivable rights.

Top Matchmaker may also use your email address, to send you other messages, including information about Top Matchmaker features and special offers. You may opt out of such email by changing your account settings or sending an email to bookings@topmatchmaker.com.au – Opting out may prevent you from receiving messages regarding Top Matchmaker Services or special offers.

• Accuracy, Completeness and Timeliness of Information

• Despite our best effort to make all information on this website accurate, we are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or timelier sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. • Prohibited Uses

• Do not use the Top Matchmaker, Top Matchmaker.com.au the Top Matchmaker logo or other registered marks trademarks in a way that would mislead consumers that you or your products or services are somehow related to, endorsed by, or affiliated with Top Matchmaker, Top Matchmaker.com.au or authors of Top Matchmaker.com.au.
• Company, Product, Service: You may not place your company name, trademarks, service marks, or product names next to (or combine them with) the Top Matchmaker registered marks trademarks.
• Logos: You may not use the Top Matchmaker logos, artwork, trade dress, designs or any combination of these, or any trademark including these (together, the “Logos”), for any purpose without prior written consent from Top Matchmaker.com.au.
• Domain Names, Meta tags, Hidden Text: You may not incorporate the Top Matchmaker registered marks or trademarks in any domain name, Meta tag, or other hidden text in a web page without prior written authorization from Top Matchmaker and Top Matchmaker.com.au or associated companies.

Internet Advertising Keywords: You may not use or incorporate the Top Matchmaker registered marks or trademarks in any internet advertising keyword, Ad Word, hashtag, or other term used to trigger advertising or search engine results without prior written permission from Top Matchmaker.com.au and associated companies. 

• Merchandise Items: You may not manufacture, sell, or give away merchandise items bearing any of the Top Matchmaker registered marks or trademarks without first obtaining a written license from Top Matchmaker.com.au.
